Third offense: Up to $10,000 in fines, 2 to 10 years in prison, and license suspension for up to 2 years.

Aggravating factors—such as a BAC of 0.15 or higher, having a child passenger, or causing serious injury or death—can result in felony charges and significantly harsher penalties. For example:

Intoxication Assault (serious injury): Third-degree felony, 2–10 years in prison.

Intoxication Manslaughter (causing death): Second-degree felony, up to 20 years in prison.
